TERMS OF SERVICE – THE POWER MOVES ACADEMY

1. Acceptance of Terms
By accessing, registering for, or using the Power Moves Academy platform (“Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”), as well as any applicable laws and regulations. If you do not agree to these Terms, you must not use the Service.
2. Eligibility
The Service is intended for individuals aged 12 years or older. Users under the age of 12 may only access the Service under the supervision and with the explicit consent of a parent or legal guardian, who agrees to be bound by these Terms on their behalf.
3. Description of Service
Power Moves Academy is a digital, subscription-based learning platform providing pre-recorded instructional video content focused on power moves, variations, and foundational breakdance techniques.
- Content: Includes a minimum of 50 videos at launch, with additional content added on a recurring basis.
- Format: All content is delivered digitally. The Service Provider reserves the right to update, modify, or remove content at its sole discretion.
4. Subscription Plans and Billing
The Service offers the following access options:
- Monthly Subscription: Automatically renewing every 30 days.
- 2-yearly Subscription: Automatically renewing every 2 years.
- Annual Subscription: Automatically renewing every 365 days.
- Lifetime Access: A one-time payment granting access for the operational lifespan of the platform.
By subscribing, you authorize recurring billing for the selected plan unless canceled prior to the renewal date. Lifetime access does not constitute ownership of the content. I agree to gain immediate access and waive my right of withdrawal.
5. Payment Terms
All payments are processed through secure third-party providers. You represent that you are authorized to use the designated payment method. You agree to keep billing information accurate. Failure to process payment will result in immediate suspension of access.
6. Right of Withdrawal & No-Refund Policy
All purchases are final. In accordance with European Union consumer protection laws regarding digital content, by subscribing or purchasing 'Lifetime Access', you expressly consent to the immediate commencement of the Service.
You hereby acknowledge and agree that you forfeit your statutory 14-day right of withdrawal (right to a refund) once the performance of the service has begun (i.e., as soon as you are granted access to the video library). Under no circumstances will refunds, credits, or partial reimbursements be issued for unused subscription periods or dissatisfaction with the content.
7. Access and Availability
Access to premium content is granted only during an active subscription period. Upon expiration or cancellation, access is revoked immediately. The Service does not guarantee 100% uninterrupted availability and may be temporarily offline for maintenance or technical updates.
8. License and Intellectual Property
Subject to compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access the content for personal, non-commercial use only.
- Ownership: All videos, methodologies, logos, and trademarks are the exclusive Intellectual Property of Power Moves Academy and its creator.
- Prohibitions: You may not reproduce, distribute, record, or publicly display the content. Using the content for your own commercial instructional purposes or reselling access is strictly prohibited and will lead to legal action.
9. Account Security & Restrictions
You are responsible for maintaining the confidentiality of your credentials.
- Limits: Each account is restricted to one individual user and one device at a time.Monitoring: The Service utilizes automated monitoring to detect simultaneous logins or IP-address irregularities. Sharing account credentials is a material breach of these Terms and will result in immediate termination of the license without notice or refund.
10. Health & Liability Disclaimer
The content involves physically demanding movements and is undertaken at your own risk. By using the Service, you acknowledge that you are voluntarily participating in physical training and are solely responsible for assessing your physical condition.
To the fullest extent permitted by applicable law, Power Moves Academy disclaims all liability for indirect damages, mental stress, or injuries resulting from the use of the content. Nothing in these Terms limits liability for damages resulting from intentional misconduct, gross negligence, or for physical injury to the extent required by mandatory Belgian law.
11. No Warranties
The Service is provided on an “as is” and “as available” basis. No warranties are made regarding specific skill progression, injury prevention, or accuracy of the results. Outcomes depend entirely on the user's individual effort and physical capacity.
12. Privacy and Data Collection
We collect personal data (name, email, payment info) and track user activity (viewing history) to deliver and personalize the Service. User activity is associated with individual accounts to monitor performance and prevent fraud. We do not sell your personal data.
13. Modifications
We reserve the right to modify these Terms at any time. Users will be provided with notice (typically via email) at least 14 days prior to significant changes. Continued use of the Service after updates constitutes acceptance of the revised Terms.
14. Termination
We reserve the right to suspend or terminate your access immediately, without notice, if you violate these Terms (e.g., account sharing, content piracy). Termination results in the immediate loss of access and forfeiture of all payments made.
15. Dispute Resolution
In the event of a dispute, the parties agree to first seek an amicable out-of-court settlement. If a resolution cannot be reached, European consumers may also utilize the European Commission's Online Dispute Resolution (ODR) platform.
16. Governing Law & Venue
These Terms shall be governed by and interpreted in accordance with the laws of Belgium. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of the judicial district where the Service Provider’s registered office is located, unless otherwise required by mandatory international consumer law.
